Terms of Service

1. Acceptance of Terms

By downloading or using NextSip (the “App”), you agree to be bound by these Terms. We built NextSip specifically for Android to provide a fast, private experience. We reserve the right to update these terms at any time; your continued use of the App following the posting of changes constitutes your acceptance of such changes.

2. Nature of Service & Data Reliance

NextSip is a Newborn Log and Partner Sync tool for personal information tracking.

  • NOT MEDICAL ADVICE: NextSip is a productivity tool, not a medical device. It is not a substitute for professional medical advice. Always consult your pediatrician regarding your baby’s health.
  • INDEPENDENT RECORDS: You acknowledge that the App relies on third-party cloud services and that data loss is a possibility. You are encouraged to maintain independent records of critical health information; NextSip is not a fail-safe medical vault.

3. Account & Partner Sync

  • Google Sign-In: To ensure a Safe Baby Log App environment, we utilize Google Sign-In. You are responsible for the security of your own Google account.
  • Shared Access: When you use the Partner Sync feature, you are granting another user access to your data. NextSip is not responsible for how your invited partners manage or share that information once access is granted.

4. One-Time Lifetime Purchase (NextSip Pro)

NextSip does not use a subscription model.

  • Lifetime Upgrade: Optional “Pro” features are available via a one-time In-App Purchase (IAP) through the Google Play Store.
  • Right of Withdrawal Waiver: By purchasing NextSip Pro, you consent to immediate delivery of digital content and acknowledge that you lose your right of withdrawal once the content is accessed.
  • No Recurring Fees: Once purchased, your Pro status is linked to your Google Play account for the life of the product.
  • Refunds: All financial transactions are processed by Google Play in accordance with their standard policies.

5. Termination & Suspension

We reserve the right to suspend or terminate your Partner Sync access or general use of the App at our sole discretion, without notice or liability, for conduct that we believe violates these Terms, involves reverse-engineering our Native Android code, or is harmful to other users or our business interests.

6. Privacy & Data Ownership

  • Ownership: You own your data. We do not sell your logs to formula companies or third-party advertisers.
  • Usage: We only process data to provide the synchronization service. See our Privacy Policy for details on our GDPR-compliant encryption.

7. LIMITATION OF LIABILITY & DISCLAIMER

EXCEPT IN CASES OF INTENT (OPZET) OR GROSS NEGLIGENCE (BEWUSTE ROEKELOOSHEID) ON OUR PART, AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. NEXTSIP AND ITS CREATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO DATA LOSS, SYNC FAILURES, OR RELIANCE ON THE INFORMATION LOGGED WITHIN THE APP.

  • Governing Law: These Terms are governed by and construed in accordance with Dutch Law. Any disputes arising from these Terms or your use of the App shall be resolved exclusively in the competent courts of the Netherlands.
  • Conformity & Updates: We provide NextSip with reasonable care. In accordance with Dutch consumer rules for digital content, we will provide updates as necessary to keep the app functional and secure. It is your responsibility to install these updates to ensure continued performance.
